PROMOTIONS AND GIVEAWAYS OFFICIAL RULES
- ELIGIBILITY:
- Promotions/Giveaways administered or promoted on our shopping center’s Facebook Timeline (Page) are in no way sponsored, endorsed, administered by, or associated with Facebook. For those administered or promoted on our other social media accounts, website or at our events are in no way sponsored, endorsed, administered by, or associated with any entity other than Macomb Mall unless otherwise noted and published.
- The Promotions/Giveaways are open to all legal residents of the 50 U.S. states and DC who are 18 years of age or older at the time of entry. Void elsewhere and where prohibited.
- Participants are only allowed to win one prize every ninety (90) days.
- Employees of Macomb Center Partners LLC, Macomb Center Holdings, LLC and its affiliates, Lormax Stern Development Company and Time Equities Inc. and associated properties, owners, principals, their parent, subsidiaries, directors, agents, representatives and employees of our contracted vendors, and their immediate family members (defined as parents, parents-in-law, children, siblings, and spouse) are not eligible to enter or win the Promotion/Giveaway prizes.
- SPONSOR:
- Macomb Mall is the sponsor of the Promotions/Giveaways unless otherwise noted or mentioned.
- AGREEMENT TO OFFICIAL RULES:
- Participation or entry into the Promotion/Giveaway constitutes the entrants full and unconditional agreement to and acceptance of these Official Rules and the decisions of Macomb Mall, which are final and binding. Winning a prize is contingent upon being compliant with these Official Rules and fulfilling all other requirements set forth herein.
- PROMOTION/GIVEAWAY PERIOD:
- Macomb Mall will determine the length of each Promotion/Giveaway and publish it with each individual event.
- HOW TO ENTER:
- Limit one (1) entry per person, per email address and per household for the duration of the Promotion/Giveaway period, regardless of method of entry (online or in person). Entries received from any person, e-mail address, or household in excess of the stated limitation will be void. All entries become the property of Sponsor and will not be acknowledged or returned. *Anyone without a Facebook account that would like to participate in the Promotion/Giveaway may enter their name at the Macomb Mall Management Office, 32233 Gratiot Avenue Roseville, MI 48066, during the contest, from 9:00 AM to 4:00 PM. The name will be added to the list of entrants from the ongoing Facebook Promotion/Giveaway.
- PRIZE DRAWING:
- A random drawing to select the winners will be made from all eligible entries received during the Promotion/Giveaway time period.
- Odds of winning a prize depend on the total number of eligible entries received at the time of the drawing.
- All decisions are final.
- WINNER NOTIFICATION AND PRIZE REDEMPTION:
- Macomb Mall will attempt to notify the potential winner via Facebook messenger on or about the day the Promotion/Giveaway ends.
- If the potential winner cannot be contacted within five (5) days after the date of the first attempt to contact him/her, Macomb Mall may select an alternate potential winner in his/her place at random from the remaining non-winning, eligible entries.
- The prize will need to be picked up at the Macomb Mall Management Office within thirty (30) days of the notification through Facebook messenger. After that time period, any unclaimed prizes are considered forfeited by the winner and returned to the property of Macomb Mall.
- The winner can designate an individual to pick up the prize on their behalf. However, Macomb Mall Management would need advance notice of who will come in to pick up the prize. They must be over 18 years of age and provide photo I.D. at time of redemption.
- Prizes can be claimed in the Macomb Mall Management Office, 32233 Gratiot Avenue Roseville, MI 48066, during the contest, from 9:00 AM to 4:00 PM.
- GENERAL CONDITIONS:
- In the event that the operation, security, or administration of the Promotion/Giveaway is impaired in any way for any reason, including, but not limited to fraud, virus, bug, worm, unauthorized human intervention or other technical problem, or in the event the Promotion/Giveaway is unable to run as planned for any other reason, as determined by Macomb Mall, in its sole discretion, may either (a) suspend the Promotion/Giveaway to address the impairment and then resume it in a manner that best conforms to the spirit of these Official Rules or (b) terminate it entirely and, in the event of termination, award the prize at random from among the eligible, non-suspect entries received up to the time of the impairment.
- Macomb Mall reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Promotion/Giveaway or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner.
- Any attempt by any person to damage the website or undermine the legitimate operation of the Promotion/Giveaway may be a violation of criminal and civil law, and, should such an attempt be made, Macomb Mall reserves the right to seek damages (including attorney’s fees) and any other remedies from any such person to the fullest extent permitted by law.
- Failure by Macomb Mall to enforce any provision of these Official Rules shall not constitute a waiver of that provision.
- RELEASE AND LIMITATIONS OF LIABILITY:
- By participating in the Promotion/Giveaway, entrants agree to release and hold harmless Macomb Center Partners LLC, Macomb Center Holdings, LLC and its affiliates, Lormax Stern Development Company and Time Equities Inc. and associated properties, owners, principals, their parent, subsidiaries, directors, agents, representatives and employees (“Released Parties”), from and against any and all claims, actions, liability and expense, including attorney fees and court costs, in connection from and against any claim or cause of action arising out of participation in the Promotion/Giveaway or receipt or use of the prize (including any travel or activity related thereto), including, but not limited to: (a) any technical errors associated with the Promotion/Giveaway, including lost, interrupted or unavailable Internet Service Provider (ISP), network, server, wireless service provider, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone, cellular tower or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties; (b) unauthorized human intervention in the Promotion/Giveaway; (c) mechanical, network, electronic, computer, human, printing or typographical errors; (d) any other errors or problems in connection with the Promotion/Giveaway, including, without limitation, errors that may occur in the administration of the Promotion/Giveaway, the announcement of the winner, the cancellation or postponement of the event if applicable, or in any Promotion/Giveaway related materials; or (e) injury, death, losses or damages of any kind, to persons or property which may be caused, directly or indirectly, in whole or in part, from entrants participation in the Promotion/Giveaway or acceptance, receipt or misuse of the prize (including any travel or activity related thereto). Entrant further agrees that in any cause of action, the Released Parties liability will be limited to the cost of entering and participating in the Promotion/Giveaway, and in no event shall the entrant be entitled to receive attorney’s fees. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Promotion/Giveaway. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
- PUBLICITY:
- Except where prohibited, participation in the Promotion constitutes entrant’s consent to Sponsor’s and its agents’ use of winner’s name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes, in perpetuity, in any and all media, manner, and formats now known or hereafter devised, without further payment or consideration.
- DISPUTES:
- Except where prohibited, each entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Promotion/Giveaway or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Michigan.
- All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrants rights and obligations, or the rights and obligations of Macomb Mall in connection with the Promotion/Giveaway, shall be governed by, and construed in accordance with, the laws of Michigan, without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than Michigan.
- PRIVACY:
- Information collected from entrants is subject to Macomb Mall’s privacy policy.
- WINNER LIST:
- To request the name of the winner, send a self-addressed, stamped envelope to: Macomb Mall Management Office c/o Winner List Request, 32233 Gratiot Avenue Roseville, MI 48066. Winner List requests will only be accepted within thirty (30) days following the promotion end date.
- NON-COMPLIANCE:
- In the event of noncompliance with these Official Rules, or if the prize is unclaimed, prize will be forfeited. PRIZES ARE AWARDED AS IS AND WITHOUT WARRANTY, GUARANTEE OR REPRESENTATION OF ANY KIND, EXPRESSED OR IMPLIED (INCLUDING WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.)
